Welcome to LuffyRobes! The terms "we", "us" and "our" refer to LuffyRobes. LuffyRobes operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Our featured product is the Luffy-Inspired Heated Robe, a red flannel robe with sherpa lining, Straw Hat Crew embroidery, a yellow sash, a blue zigzag hem and a built-in heating pad (the "Robe"). LuffyRobes is powered by Shopify, which enables us to provide the Services to you.
These terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability. By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use or access our Services.
## Section 1 - Access and Account
By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, and that you consent to any of your minor dependents using the Services on devices you own, purchase or manage. To use the Services, including purchasing a Robe, you may be asked to provide your email address, billing, payment and shipping information. You represent and warrant that all information you provide is correct, current and complete and that you have all rights necessary to provide it. You are solely responsible for the security of your account credentials and for all account activity. You may not transfer, sell, assign or license your account to any other person.
## Section 2 - The Robe
We have made every effort to represent the Robe accurately. However, colors and product appearance, including the red flannel, white sherpa lining, yellow sash, blue hem and embroidery, may differ from how they appear on your screen due to your device and its settings. Product images, including illustrations, infographics and lifestyle photos, are for demonstration. We do not warrant that the appearance, size, feel or quality of the Robe will meet your expectations or be identical to what is depicted. The Robe is described as oversized, so please review the size information before ordering.
Statements such as "warms in 60 seconds" describe typical performance under normal conditions. Actual warm-up time and heat level depend on the power source, room temperature, how the Robe is worn and the heat setting selected (H1, H2 or H3). All product descriptions are subject to change without notice. We may discontinue the Robe or any variant at any time and may limit quantities to any person, region or jurisdiction.
## Section 3 - Heating Function, Safety and Care
By purchasing the Robe, you agree to the following:
1. **Power source.** The Robe's heating pad connects by USB cable to a wall plug or a fully charged power bank, which is placed in the Robe's pocket. Use only a power source that meets the specifications included with your Robe. We are not responsible for damage caused by incompatible, damaged or counterfeit chargers or power banks. A power bank may not be included unless your order says so.
2. **Use.** Use the controller (H1, H2 or H3 settings and the on/off button) as instructed. Turn the heat off when not in use. Do not use the Robe if the heating pad, cable, controller or fabric appears damaged, wet or overheated.
3. **Do not modify** the heating pad, cable, controller or power bank, and do not cut, fold sharply or pierce the heating element.
4. **Medical and special-needs users.** The Robe is not a medical device. If you have reduced sensitivity to heat, a medical condition, an implanted device or are pregnant, consult a doctor before use. Children, and anyone unable to remove the Robe or operate the controller, should be supervised.
5. **Care.** Before washing, unplug and remove the controller, cable and power bank from the pocket. Machine wash on a gentle cycle. Do not iron and do not shrink the Robe. Do not use the heating function while the Robe is wet. Follow the care label.
6. **Misuse.** Damage resulting from failure to follow these instructions, including washing with the electronics inside, may not be covered by any return, refund or warranty.
## Section 4 - Orders
When you place an order, you are making an offer to purchase. LuffyRobes may accept or decline your order for any reason. Your order is not accepted until LuffyRobes confirms acceptance, and we must receive and process payment first. Please review your order carefully, including size and color, as we may be unable to accommodate cancellation requests after acceptance. If we do not accept, change or cancel an order, we will attempt to notify you using the email, billing address and/or phone number provided. Returns and exchanges are governed solely by our Refund Policy. You represent that your purchases are for personal or household use and not for resale or export.
## Section 5 - Prices and Billing
Prices, discounts and promotions are subject to change without notice. The price charged will be the price in effect when the order is placed, as shown in your order confirmation email. Unless stated otherwise, posted prices do not include taxes, shipping, handling, customs or import charges. Promotions are governed by their own terms, which prevail over these Terms in a conflict. You agree to provide current, complete and accurate purchase, payment and account information and to update it promptly. You represent and warrant that (i) the card information you provide is true and complete, (ii) you are authorized to use the card, (iii) charges will be honored by your card company, and (iv) you will pay all charges at the posted prices, including shipping, handling and taxes.
## Section 6 - Shipping and Delivery
Delivery times are estimates only and are not guaranteed. We are not liable for delays caused by carriers, customs processing or events outside our control. International customers are responsible for any duties, import taxes and customs fees. Once we transfer the Robe to the carrier, title and risk of loss pass to you.
## Section 7 - Intellectual Property and Third-Party Trademarks
Our Services, including text, images, graphics, product reviews, video, audio and the design, selection and arrangement of them, are owned by LuffyRobes, its affiliates or licensors and are protected by intellectual property laws. You may use the Services for personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store or transmit any material on the Services without our prior written consent. LuffyRobes names, logos and slogans are trademarks of LuffyRobes or its affiliates or licensors, and Shopify's are trademarks of Shopify.
The Robe is "Luffy-inspired" and features Straw Hat Crew-style imagery. "One Piece", "Monkey D. Luffy", the Straw Hat Pirates and related names, characters and logos are the property of their respective owners. Unless expressly stated on the product page, LuffyRobes is not affiliated with, endorsed by or sponsored by those owners. All other names and logos on the Services are the trademarks of their respective owners.
## Section 8 - Optional Tools
We may provide access to third-party tools, which we do not monitor or control. They are provided "as is" and "as available" without warranties of any kind or endorsement. We have no liability arising from your use of optional third-party tools, which you use at your own risk. New features we release become part of the Services and are subject to these Terms.
## Section 9 - Third-Party Links
The Services may contain links to websites operated by third parties. We are not responsible for the content or accuracy of those sites, and you access them at your own risk. Complaints about third-party products and services, including power banks and chargers not sold by us, should be directed to the third party.
## Section 10 - Relationship with Shopify
SlopePunk is powered by Shopify, but all sales are made directly with SlopePunk. Shopify is not responsible for any aspect of any sale between you and SlopePunk, including injury, damage or loss resulting from purchased products. You release Shopify and its affiliates from all claims, damages and liabilities arising from your purchases from SlopePunk.
## Section 11 - Privacy Policy
Personal information we collect is subject to our Privacy Policy, and certain information may be subject to Shopify's Privacy Policy. Because the Services are hosted by Shopify, Shopify collects and processes information about your use of the Services. Information you submit will be shared with Shopify and third parties, who may be located in other countries, in order to provide services to you. Please review our Privacy Policy for details.
## Section 12 - Feedback and Reviews
If you submit any ideas, suggestions, reviews, photos, videos or other content about the Robe or our Services (collectively, "Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display it in any medium for any purpose, including commercial use and promotion of the Robe. You represent and warrant that (i) you own or have all necessary rights to the Feedback, including rights in any photos or videos and the consent of anyone pictured; (ii) you have disclosed any compensation, free product or incentive received in connection with it; (iii) your review reflects your genuine experience with the Robe; and (iv) it complies with these Terms.
We have no obligation to keep Feedback confidential, pay for it or respond to it. We may, but need not, monitor, edit or remove Feedback that we determine is unlawful, offensive, threatening, defamatory, obscene, misleading or otherwise objectionable, or that infringes anyone's rights. Your Feedback must not contain unlawful or abusive content or malware, and you may not use a false email address or pretend to be someone else. You are solely responsible for your Feedback and its accuracy, and we assume no liability for Feedback posted by you or any third party.
## Section 13 - Errors, Inaccuracies and Omissions
Information on the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, sizing, shipping charges, transit times and availability. We reserve the right to correct them and to update information or cancel orders if information is inaccurate, at any time and without prior notice, including after you have submitted your order.
## Section 14 - Prohibited Uses
You may use the Services for lawful purposes only. You may not use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any law, regulation or ordinance; (c) to infringe our intellectual property or that of others; (d) to harass, abuse, defame or intimidate any person; (e) to transmit false or misleading information; (f) to transmit spam or unsolicited promotional material; (g) to impersonate any person or entity; or (h) to engage in conduct that restricts anyone's use of the Services or may harm SlopePunk, Shopify or other users.
You also agree not to: (a) upload malicious code; (b) reproduce, copy, extract, sell or resell any portion of the Services, including the Robe's product images, designs and descriptions; (c) collect the personal information of others; (d) spam, phish or pretext the Services; (e) use robots, spiders, scrapers, data extraction tools, automated devices or AI tools (such as agentic AI) to access the Services except as permitted by Section 15; or (f) bypass security, authorization features or robot exclusion headers. We may suspend or terminate your account at any time, without notice, if we determine you have violated these Terms.
## Section 15 - Agents
15.1 This section ("Agent Terms") applies if you use, allow, enable or cause the deployment of an Agent to access, use or interact with the Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity and that can be executed on or using a person's device without direct supervision.
15.2 No Agent may access, use or interact with the Services unless, at all times, it identifies itself and operates in strict accordance with Section 15.4. No Agent may access the Services if we have requested that it refrain from doing so.
15.3 We may limit, including by technical measures, whether and how any Agent accesses, uses and interacts with the Services.
15.4 Agents must: (i) in all HTTP/HTTPS requests, identify that the request is from an Agent by including "Agent/[agent name]" in the user agent string; (ii) not conceal that any interaction is from an Agent, including by mimicking human behavior or completing or circumventing CAPTCHAs or other measures intended to distinguish computers from humans; (iii) respond truthfully to any question seeking to determine whether interactions come from a human or a computer; and (iv) not circumvent any measure intended to block, limit, modify or control Agent access.
## Section 16 - Termination
We may terminate this agreement or your access to the Services in our sole discretion at any time without notice, and you remain liable for all amounts due through the date of termination. The following sections survive termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive.
## Section 17 - Disclaimer of Warranties
Information presented through the Services is for general information purposes only. We do not warrant its accuracy, completeness or usefulness, and any reliance on it is at your own risk.
EXCEPT AS EXPRESSLY STATED BY LUFFYROBES, THE SERVICES AND ALL PRODUCTS, INCLUDING THE ROBE AND ITS HEATING COMPONENTS, ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY REPRESENTATION, WARRANTY OR CONDITION OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THIS DISCLAIMER MAY NOT APPLY TO YOU.
## Section 18 - Limitation of Liability
TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL SLOPEPUNK, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA OR REPLACEMENT COSTS, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR THE ROBE, INCLUDING DAMAGE ARISING FROM MISUSE OF THE HEATING FUNCTION OR FROM THE USE OF POWER BANKS OR CHARGERS NOT SUPPLIED BY US, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.
## Section 19 - Indemnification
You agree to indemnify, defend and hold harmless LuffyRobes, Shopify and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party arising out of (1) your breach of these Terms or the documents they incorporate, (2) your violation of any law or third-party right, or (3) your access to and use of the Services. We will notify you of any indemnifiable claim, though a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement at your expense but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will cooperate in the defense, including by providing relevant documents.
## Section 20 - Severability
If any provision of these Terms is determined to be unlawful, void or unenforceable, it will be enforced to the fullest extent permitted by law, and the unenforceable portion will be severed without affecting the validity of the remaining provisions.
## Section 21 - Waiver; Entire Agreement
Our failure to exercise or enforce any right or provision of these Terms is not a waiver of it. These Terms and any policies or operating rules we post constitute the entire agreement between you and us and supersede any prior agreements, communications and proposals, including prior versions of these Terms. Ambiguities will not be construed against the drafting party.
## Section 22 - Assignment
You may not delegate, transfer or assign this agreement or any of your rights or obligations without our prior written consent, and any attempt to do so is void. We may transfer, assign or delegate these Terms and our rights and obligations without consent or notice.
## Section 23 - Governing Law
These Terms and any separate agreements under which we provide you Services are governed by and construed in accordance with the laws of, and the federal and state or territorial courts in, the jurisdiction where LuffyRobes is headquartered. You and LuffyRobes consent to venue and personal jurisdiction in those courts.
## Section 24 - Headings
Headings are included for convenience only and do not limit or affect these Terms.
## Section 25 - Changes to Terms of Service
You can review the most current version of these Terms at any time on this page. We may update, change or replace any part of them by posting changes to our website, and it is your responsibility to check periodically. We will notify you of material changes in accordance with applicable law, effective on the date specified in the notice. Continued use of the Services after changes are posted constitutes acceptance.
